That language was declared unconstitutional by the Washington State Supreme Court in Spokane v. Fischer, 110 Wn. 2nd 541 (1988). A modification to the old language of CMC 6.08.140 will establish new standards to correct the deficiency, which must be met before enforcement can occur.
