Additionally, at the August 17, 2015 Council Workshop, staff presented a revised Interlocal Agreement and additional environmental research on three properties located in the industrial subdivision to the west of the proposed wellfield property that have been identified by the Department of Ecology as having contaminated soils. The attached copy of the final Utilities Cooperation Agreement was presented for Council's consideration. Staff and the City Attorney have worked extensively with Green Mountain PRD representatives over the last few months to draft an agreement for Council's consideration. The concept and general provisions of the draft agreement have been presented to the City Council at prior Council Workshops; however, information from Green Mountain PRD representatives has recently been received by staff which warranted further negotiations with the developer.
